These Terms & Conditions (“Terms”) govern your use of the NicheGraph website at nichegraph.com, the NicheGraph web application at app.nichegraph.com, and the NicheGraph browser extension (collectively, the “Service”), operated by NicheGraph (“we”, “our”, “us”).
By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Service Description
NicheGraph is a YouTube channel analytics and discovery platform. The Service provides:
- Searchable database of YouTube channels with public statistics
- Channel analytics, growth tracking, and performance estimates (including estimated revenue ranges based on public data)
- Outlier video detection, rising-channel identification, and niche research tools
- Saved searches, watchlists, and channel collections for registered users
- A browser extension for on-page YouTube channel insights
Revenue figures, audience estimates, and growth projections shown on the Service are estimates derived from public data and models, not official YouTube Analytics data, unless explicitly labelled as connected-account data.
2. Accounts
You must provide accurate information when creating an account and keep your credentials secure. You are responsible for activity under your account. You must be at least 13 years old to use the Service.
3. Subscriptions and Payments
Paid plans are billed in advance on a recurring basis as described at checkout. Prices are shown in USD unless stated otherwise.
3.1 No-refund policy
All purchases are final. We do not offer refunds. By purchasing a subscription, you acknowledge and agree that fees paid are non-refundable, including for partial months, unused time, or cancellation before the end of a billing period. You may cancel at any time; cancellation takes effect at the end of the current billing period.
4. Acceptable Use
You agree not to:
- Violate any applicable law or the YouTube Terms of Service
- Attempt to gain unauthorised access to the Service, other accounts, or our systems
- Scrape, crawl, or use automated means to extract data from the Service except through our official extension or API
- Resell, redistribute, or republish substantial portions of our data without written permission
- Upload malicious code or interfere with the operation of the Service
We may suspend or terminate accounts that violate these Terms.
5. Intellectual Property
The Service, including its design, text, graphics, software, and compiled analytics, is owned by NicheGraph and protected by intellectual property laws. YouTube channel data shown is public third-party data; YouTube™ is a trademark of Google LLC.
6. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that estimates will match actual channel performance.
7. Limitation of Liability
To the maximum extent permitted by law, NicheGraph shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, or data, arising from your use of the Service. Our total liability shall not exceed the fees you paid in the 12 months preceding the claim.
8. Governing Law
These Terms are governed by the laws of England and Wales, United Kingdom, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
9. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced on the Service. Continued use after changes constitutes acceptance.
